A marriage contract determines the distribution of your property in the event of death or divorce. However, your last will and will, which deals with the division of property after death, can determine the distribution of your property if your marriage contract is not established correctly. Currently, 28 states and the District of Columbia have passed a version of the Uniform Premarital Agreement Act (UPAA) or the Uniform Premarital Act (UPMAA). The UPAA was adopted in 1983 by the Uniform Law Commission (ULC) to promote greater uniformity and predictability between state laws regarding these contracts in an increasingly ephemeral society.
